Terms of Service
Draft, last updated 3 November 2026
1. About these terms
Texts from the Dead is run by Kieran Lear, of Suite RA01, 195-197 Wood Street, London E17 3NU ("we", "us"). These terms cover your subscription to our service: one text message a day containing a quotation from a public-domain work of philosophy or literature.
2. Who can subscribe
- You must be 18 or over.
- Your mobile number must be in the United States, Canada, the United Kingdom or Australia.
- The number must be yours, or you must have the account holder's permission to receive texts on it.
3. Plans and prices
You can subscribe monthly or annually. Prices are shown in your local currency (pounds, US dollars, Canadian dollars or Australian dollars) before you pay, and payments are processed by Stripe.
Founding-member offer:
- The first 100 people to subscribe to the annual plan pay the annual price for their first 18 months instead of 12. After that, the subscription renews at the annual price each year until you cancel.
- The 18 months start when your free trial ends, or when you subscribe if your number has had a trial before.
- A place is taken when a founding member's subscription starts. If one is cancelled during the free trial, before anything is paid, the place goes back to the offer. Our home page shows how many places are left, and the offer ends when there are none.
- Checkout shows whether you are getting the offer before you pay.
4. Free trial
- Both plans start with a 7-day free trial. A payment card is required.
- There is one free trial per phone number. A number that has had a trial before starts on a paid subscription straight away.
- If you don't cancel before the trial ends, your first payment is taken automatically when it ends. We email you a reminder before that first charge.
- If you cancel during the trial, you won't be charged and your texts stop when the trial ends.
5. Automatic renewal
Your subscription renews automatically at the end of each billing period (every month or every year, depending on your plan; for founding members, after the first 18 months and then every year) and we charge your card each time, until you cancel. If we change the price, we will tell you by email before the new price applies, and you can cancel before it does.
6. Cancelling
- You can cancel online at any time from the Manage subscription page or the link in your welcome text.
- Cancellation takes effect at the end of the period you have already paid for, and your texts continue until then.
- If you opt out of our texts (see the SMS Terms), we cancel your subscription immediately so you aren't charged for texts you no longer receive.
7. Failed payments
If a payment fails, we will try again over the following days. If we still can't collect it, your subscription ends and your texts stop.
8. Refunds and your legal rights
Except where the law requires otherwise, we don't give refunds for part of a billing period. Nothing in these terms affects your statutory rights as a consumer where you live.
9. The texts
- Our quotations come from public-domain works and translations, many of them centuries old, and keep their original wording. Some of that language is old-fashioned.
- The texts are for reflection and enjoyment. They are not medical, psychological, legal or financial advice.
- Texts are delivered by mobile carriers. We aim to deliver each one at 8:00 your local time, but we can't guarantee delivery times and carriers are not liable for delayed or undelivered messages.
10. Changes to the service or these terms
We may change the service or these terms. If a change materially affects you, we will email you before it takes effect.
11. Our liability
We are responsible for losses you suffer that are a foreseeable result of our breaking these terms or failing to use reasonable care. We don't exclude liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
12. Governing law
These terms are governed by the law of England and Wales. If you live elsewhere, you keep the protection of the mandatory consumer laws of the country or state where you live, and you can bring claims in your local courts.
